DISPUTE RESOLUTION
In today�s business environment effective
dispute resolution is essential in preventing serious
financial hardship, inconvenience, wasted resources
and distractions from normal business routines. In
some instances the very survival of a business is
at stake. Whether it is your company's new patent,
its reputation from defective components or just
getting paid, a business must be able to resolve
their disputes quickly, fairly and cost effectively.
Everyone knows that litigation is terribly expensive
and very slow. We all have heard horror stories of
ridiculously unreasonable results. That is why today's
businesses are turning to Alternate Dispute Resolution
(ADR) to replace litigation. ADR is cheaper, faster
and more predictable than litigation. Instead of
both sides paying for armies of lawyers, a single
mediator or arbitrator can be used (and his/her fees
are usually less than one of the many lawyers he/she
replaces). ADR is confidential; there are no public
courts for everyone to intrude into your firm�s
business affairs in. ADR also helps protect valuable
relationships. While there may be a dispute, a cost
effective and confidential mechanism is much less
likely to cause the animosity requisite to motivate
parties to permanently terminate business relationships.
The two principal mechanisms we provide are Mediation
and Arbitration. Mediation is completely consensual
and non-adjudicatory. The Mediator helps the parties
reach an agreement to resolve the dispute by a combination
of information exchange and dialog. Arbitration is
adjudicatory, the arbitrator hears each parties case
and renders a decision. Arbitration is usually binding
while mediation is not. Mediation is particularly
effective in promoting a resolution while maintaining
a business relationship.
