GAMS Mediation Process

One of the benefits of mediation is its flexibility and absence of rigid rules. Each of our mediators has the capability to be flexible, each mediation is conducted in a way best suited to the parties and the dispute. Our mediators make the best effort possible in order to assist the parties in reaching an agreement.

Once the parties file a signed Request for Mediation and pay their administration fee and deposit, the mediator takes charge and the journey to resolution is begun.

Here is a brief overview of the most common flow of a mediation. Individual cases do vary and this information is provided to give a general understanding of mediation.

  1. Realization - The parties agree to mediate, THEIR FIRST POSITIVE AGREEMENT!
  1. Committment - A mediator who has the experience and training to best facilitate a negotiated agreement between the parties is chosen by GAMS.
  1. Explanation - Each party submits whatever information it feels necessary to clarify its position to the mediator.
  1. Review - The mediator reviews the submitted information to understand the initial claims and positions of the parties.
  1. Compromise - An initial meeting is set. This is the first joint meeting between the parties and the mediator. The mediator discusses the dispute and the positions of the parties.
  1. Facilitation. The mediator works with the parties, both individually and jointly to help them narrow the differences and promote compromise.
  1. Agreement. The parties, through the input and assistance of the mediator reach an agreement that all can live with.
  1. Memorialization. The final step. The agreement of the parties is put into a form that defines the agreement and instructs the parties of what they are expected to do.
